UK courts have referred to the Court of Justice a case on whether or not a person who is a naturalised citizen (now Spanish and British dual citizen) still benefits from the EEA Regulations/Citizens Rights Directive. The key question is whether the claimant can benefit from the family reunion provisions of EU law, which are less stringent than UK law applicable to UK nationals (where there is a very high income threshold).
